Viva Prints will not be held responsible for pricing discrepancies due to errors in website functionality.

All product photos are for illustrative purposes only.

All registered trademarks and trademarks are the property of their respective owners. The actual product may vary in design.

All quotes are valid for 30 days from the quotation date and do not include taxes.

All prices, specifications, and promotional offers are subject to change at Viva Prints’ discretion.

Allow ±2% difference for the finished image size. Allow ±5% difference for over and underruns.

There may be up to a 5% variance in color due to print settings and the calibration of the machines used.

There may be up to a 5% variance in shifting caused by automated cutting.

Full payment is required before orders are processed.

If the design is involved, a 50% deposit is required and the remaining balance is required after approval before production.

The file provided by the client will be printed AS IS.

Custom Artwork

Custom Artwork constitutes art that is created, edited, or modified by a member of the Viva Prints Design Team and is subject to a design charge of the current rate in 0.25-hour increments. All changes must be requested together. Each subsequent change may be subject to a minimum design charge of 0.25 hours at the current rate.

Design Approvals

Please carefully review all provided proofs for color, sizing, content, etc. Approval of a design indicates the release of any liabilities to Viva Prints regarding all provided proofs. No projects will be submitted to print without WRITTEN approval.

Print-Ready Artwork

Print-ready Artwork constitutes files that are submitted by the customer that require no additional edits or modifications before production. They will be printed AS-IS. It is agreed that Viva Prints will not be liable for any errors, including spelling, grammar, text changes, or color variance.

Images and Photos

Viva Prints strives to ensure that only royalty-free images are used in custom designs. It is agreed that Viva Prints, its officers, employees, shareholders, directors, and suppliers will not be held liable for any damages, costs, and/or expenses, including legal fees, arising out of related issues of copyright or trademark infringement.

Online Promotions

Online promotions may not be applied to retail orders unless otherwise stated. Promo codes are valid for use only under their specified requirements and only for products that are not already specially discounted, on sale, promoted, or under 24-hour turnaround times with exceptions explicitly stated.

Claims

Claims for defects, damages, and/or shortages must be made by the client in writing within a period of five (5) days after delivery of all or any part of the order. Failure to make such a claim within the stated period shall constitute irrevocable acceptance and an admission that the client fully complies with terms, conditions, and specifications.

Payment

Viva Prints requires full payment to process any orders. Processing of an order will not start until you have made payment with a valid credit card number. Viva Prints will not be liable for any delay in completing orders due to your delay in payment.

Refunds

Viva Prints does not offer cash refunds. All sales are final, and any disputes regarding your order must be presented within 5 business days. In any event, if a refund is required, it will be presented in the form of a store or online credit.

Order Approval and Proofing

Viva Prints has and assumes no obligation to proof or otherwise review the content or layout of your order. Even if a Viva Prints customer service representative has inquired as to the attributes of one of your prior orders, you are not entitled nor should you assume that Viva Prints will review any other order you place. Orders are printed in their “as submitted” form, and the customer is fully responsible for final proof and layout verification and approval prior to submission to the print process. Viva Prints DOES NOT make any changes to customer files. Once you submit an order to the print process, you are agreeing that you are fully satisfied with the document layout and content and that you accept responsibility for any errors therein. Viva Prints will assume that you have verified the spelling, grammar, content, and layout of your order. Viva Prints will not accept any liability for errors such as misspellings, graphics, grammar, damaged fonts, punctuation, transparency, overprint, improper layout, bleeding, erroneous cut or fold lines, die lines or crop marks, sizing, etc.

Viva Prints does not provide proofs for any order unless the customer requests it as part of the order process and it is an option available for the product. If you request proof, then it is your responsibility to verify the proof against the original (and to correct any spelling or grammatical errors, etc.).

If proof is requested, then your order will not be processed or deemed production-ready until you have approved the proof in writing. Please be aware that this may impact the job turnaround time.

Transfer of Title

The customer agrees that the shipping terms for all printed products are FOB shipping point, and ownership transfers to the customer upon shipment. This means that the risk of loss and title for such items passes to the customer upon our delivery to the carrier. For any product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such product shall be deemed to have occurred either (a) at the time we transmit the product via email or other electronic communication addressed to the customer or (b) at the time we transmit a notification to the customer that the product is available for downloading from the Site.

Disclaimer of Warranty

The site and its content are provided “as is” without warranty of any kind, either expressed or implied, including, but not limited to: warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that the operation of the site may not be uninterrupted or error-free. References and links to products or services of independent companies may appear on the site. These references and links are provided “as is” without warranty of any kind, either expressed or implied.

Limitation of Liability

In no event shall Viva Prints or its licensors, suppliers, or vendors, their officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not Viva Prints has been advised of the possibility of damage arising out of or in connection with the use or performance of the site, or of failure to provide products or services that you order from Viva Prints or its affiliates, including without limitation, damages arising from the mistake, omission, virus, delay, or interruption of service. In no event shall Viva Prints be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content.

Indemnification

It is agreed to indemnify, defend, and hold harmless Viva Prints, its officers, employees, shareholders, directors, and suppliers against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement. It is also agreed that approval of the artwork and instruction to proceed with the production constitutes full acceptance of the terms, conditions, and specifications mentioned above.

Online Promotions

General conditions

– Any online promotion, deal, or coupon is subject to change without prior notice at the sole discretion of Viva Prints.

– Validity of the promotions, deal, or coupon is as communicated on the communication materials.

– Any two promotions offered cannot be combined with each other unless otherwise stated in the promotion.

– All prices mentioned are in CAD and exclude taxes and shipping. Prices are subject to change without prior notice.
